Terms of Service

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you ("you", "Customer") and Sigma Tech Communications LLC ("Sigma Tech", "we", "our") governing your use of Sigma SNS (the "Service"). By creating an account or otherwise using the Service you agree to these Terms.

2. Service description

Sigma SNS helps businesses generate captions and prepare content for posting to third-party social media platforms, and, for eligible plans, publishes content on your behalf. The Service interacts with Meta Platforms, Inc. services (Instagram, Facebook) and other integrations as you authorize.

3. Eligibility and accounts

You must be at least 18 years old and authorized to act for your business to create an account. You are responsible for keeping your login credentials secure and for all activity under your account, including activity by staff you grant access to.

4. Subscriptions and billing

  • Paid plans are billed monthly in advance. Pricing is presented at signup and in your dashboard.
  • Subscriptions renew automatically until cancelled. You can cancel at any time; cancellation stops the next renewal and you keep access until the end of the current billing period.
  • Fees are non-refundable except where required by law.
  • Exceeding your plan's monthly post allowance may pause new AI generation until the following cycle or until you upgrade.

5. Acceptable use

You agree not to use the Service to:
  • Post content that is unlawful, defamatory, harassing, or infringes intellectual property.
  • Send spam, malware, or abusive automation to third parties.
  • Impersonate another person or business.
  • Circumvent pricing, rate limits, or other Service controls.
  • Violate the policies of connected third-party platforms (e.g., the Meta Platform Terms and Community Guidelines).

6. Your content

You retain all rights to the photos, videos, captions, and other content you upload or generate through the Service ("Customer Content"). By using the Service, you grant Sigma Tech a limited license to store, display, process, and transmit Customer Content solely for the purpose of operating the Service for you. This includes sending content to Anthropic for AI processing and to Meta or other platforms when you authorize publishing.

You represent that you have the rights to all Customer Content, including any model or location releases where applicable.

7. AI-generated content

Captions and hashtags generated by the Service are produced by third-party AI systems. You are responsible for reviewing AI output before publishing or sharing. AI output may contain errors, inaccurate claims, or content inconsistent with your brand; we do not guarantee suitability for any specific purpose.

8. Third-party platforms

When you connect an Instagram, Facebook, or other third-party account, your use of those platforms is governed by their own terms. Sigma Tech is not responsible for changes, outages, or content decisions made by third-party platforms. We may suspend specific integrations to comply with a third party's policies or technical requirements.

9. Intellectual property

The Service itself — including software, branding, templates, and documentation — is owned by Sigma Tech and protected by U.S. and international copyright, trademark, and other laws. Nothing in these Terms transfers ownership of the Service to you.

10. Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms, fail to pay fees, or if required by law or a third-party platform. You may terminate your account at any time from your dashboard or by emailing info@sigmatechcomm.com.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SIGMA TECH DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIGMA TECH'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES.

13. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Any dispute arising under these Terms will be resolved in the state or federal courts located in Fairfax County, Virginia, and you consent to their jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. We will notify you through the Service or by email before material changes take effect. Continued use after the effective date constitutes acceptance.
